You may not replicate or in any way forge any of the applications and media found on the baskinrobbins.com.my website including videos or product images without the consent from Baskin-Robbins™ . You are however allowed to refer to these media on another, given that it is unaltered and credited from Baskin-Robbins™

The media used in the baskinrobbins.com.my website including images, templates and videos are the sole proprietary of Baskin-Robbins™ . Any attempts of claiming the content as your own will subject to copyright infringement.

The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission. Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. Baskin-Robbins™ and baskinrobbins.com.my reserves the right to terminate their services when the corresponding individual is found to be involved in an abuse or misuse of their services.
 

3.1 Terms of Use

By using the Site, you represent and warrant that you agree to comply with these Terms of Use (1) you are not a minor in the jurisdiction in which you reside; (2) you will not access the Site through automated or non-human means, whether through a bot, script or otherwise; (3) you will not use the Site for any illegal or unauthorized purpose; and (4) your use of the Site will not violate any applicable law or regulation.
 

4. Disclaimer

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the price, colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change and may vary for different outlets.
 

5. Club 31 Users and Accounts

You will need to create and register an account via the Application or Web in order to join the Club 31 Program (see Section 10 for the terms that apply to the Club 31 Program). You must follow the prompts in the Application or Web and provide the required information.
 

To participate in the Club 31 Program offered in Malaysia, you must:

  1. Use a valid Malaysia phone number when creating your account;
  2. Download the Application from a Malaysia app store OR access https://live.prodapp.baskinrobbins.my/oms/#/;
  3. Use the Club 31 Program to collect Club 31 Points and redeem vouchers, offers and coupons at Baskin-Robbins retail outlets located only in Malaysia; and be eligible to enter into a contract in Malaysia under Malaysian laws.
     

In creating an account, you agree to:

  1. Create only one account for the Application or Web;
  2. Provide honest, accurate, current and complete information regarding yourself; keep your profile, contact and other account information updated and accurate; keep your account password private and not share it with others; and notify us if you discover or suspect that your account has been hacked or its security breached
     

You also agree to take responsibility for all activities on or under any account registered to you and you accept all risks for any unauthorized use of your account.
 

We reserve the right, without notice and in our sole discretion at any time, to terminate your right to access and use the Application or Web or any component of it and to block or prevent future access to and use of the Application or Web and to delete your account and any related information. Any obligation or liability incurred prior to our termination of your access to the Application or Web will survive such termination.
 

5.1 Club 31 Loyalty Program

Registration. To participate in our loyalty program (the “Club 31 Program”), you must register using the Application or Web. When you download the Application or access the Web and/or enrol in the Club 31 Program, you agree to these Terms, which govern your participation in Club 31 Program.
 

Earning Club 31 Points and Club 31 Perks. The Club 31 Program offers various rewards, vouchers, coupons and other offers (“Club 31 [”) to you as a member of the Club 31 Program. For each ringgit (MYR) that you spend at participating Baskin-Robbins Malaysia’s locations, you will be awarded one reward point (a “Club 31 Point”). At the time of purchase, you will need to present your membership QR code or the phone number associated with your Club 31 Program account in order to earn Club 31 Points. The number of Club 31 Points that you accumulate will determine your membership Tier throughout the calendar year. The more Club 31 Points that you accumulate, the more Club 31 Perks that are available to you. At each membership Tier, additional Club 31 Perks may be available to you for redemption. Your Club 31 QR code should be presented before a transaction is completed in order to collect Club 31 Points. Additional terms and conditions may apply; see the terms and conditions of each offer for details. In the event of a conflict between these Terms and the terms and conditions of a Club 31 Perk, the terms and conditions of the specific Club 31 Perk will control with respect to such Club 31 Perk.
 

When you take various actions or complete various tasks, you will have the opportunity to earn additional Club 31 Points or other Club 31 Perks. Examples of Club 31 Points or Club 31 Perks that may be available to you which will be stipulated in the Application are subjected to each terms and conditions.
 

The opportunities to earn Club 31 Points and Club 31 Perks listed above are provided as examples and such Club 31 Points and Club 31 Perks may change at any time without notice. Check the Application for the Club 31 Perks that are currently available. Additional terms and conditions apply to the earning and redemption of Club 31 Points and Club 31 Perks. Please check the terms and conditions applicable to each Club 31 Perks or Club 31 Point opportunity.
 

5.2 Additional Terms Applicable to Earning Club 31 Points

The following terms and conditions apply to earning Club 31 Points:

  1. Club 31 Points are calculated based on your total purchase price and are rounded down to the nearest dollar after discounts. For example, if your total purchase price after discounts is RM 5.85, you will earn 5 Club 31 Points.
  2. Club 31 Points are calculated based on your total purchase prices, including sales tax.
  3. Club 31 Points are not awarded when you use a voucher, but Club 31 Points are awarded for your total purchase price (after discounts) that exceeds the voucher.
     

Any purchases made using a Third Party Platform do not earn Club 31 Points.
 

If you cancel a transaction or make a return, then the corresponding number of Club 31 Points will be deducted from your Club 31 Point balance.
 

You may only provide one membership QR code (or membership phone number) when earning Club 31 Points for a transaction. In other words, Club 31 Points earned for a single transaction may only be applied to one Club 31 Program account.

  1. Update Full Profile: You may earn Club 31 Points once you have fully completed all fields in your membership profile. If you do not complete all fields, you will not earn any Club 31 Points.
  2. Sign Up to Club 31 Program: You may earn Club 31 Points upon completing your registration for the Club 31 Program.
  3. Invite Friends: You may earn Club 31 Points for friends that you invite and that complete a registration for a new Club 31 Program account using the correct referral code during the registration process. This offer is not valid for friends that are existing members and you will not earn Club 31 Points for inviting a friend that is already a registered member of the Club 31 Program. We are not responsible for missing referral codes or referral codes that are incorrectly entered.
  4. Sharing a Coupon with a Friend. You may have the opportunity to share a coupon with a friend. Coupons that may be shared with friends may only be shared once and once you share the coupon, it will no longer be available to you in your Club 31 Program account. If you share a coupon with multiple friends, then the first friend that redeems the coupon can enjoy the coupon, but the coupon will no longer be available for other friends and the coupon cannot be redeemed more than once. Expiration dates and other limitations that apply to the coupon will continue to apply once the coupon has been shared. Additional terms and conditions may apply. See the specific coupon for additional details.
  5. Club 31 Points Expiration. Club 31 Points expire twelve (12) months after the month in which they are earned. For example, if you earn 10 Club 31 Points on January 15, 2021, those 10 Club 31 Points will expire on 1 Feb 2022. Expiration dates cannot be modified or extended.
     

Club 31 Point Tiers. The Club 31 Perks that are available to you will depend on the “Tier” that you have achieved. See the Application for the Tier levels that are available and the number of Club 31 Points that are required to achieve the next Tier. As of the Last Updated Date, the Tiers are as follows:

  1. Tier 1: 0-399 Club 31 Points
  2. Tier 2: 400-999 Club 31 Points
  3. Tier 3: 1000 or more Club 31 Points 
     

Members that achieve Tier 2 will not have access to unredeemed Tier 1 offers and members that achieve Tier 3 will not have access to unredeemed for Tier 1 and Tier 2 offers. On each January 1st, you will be assigned to a Tier based on your current Club 31 Point balance as of January 1st. You will be eligible to receive Club 31 based on your Tier and, unless these Terms or a specific Club 31 Perk states otherwise, you will continue to have access to unredeemed coupons and vouchers that have not expired based on the expiration date applicable to such coupon or voucher.
